General Conditions

EbooSystem.com is an information and online language course booking system whose ownership belongs to EbooSystem S.L. By the mentioned system EbooSystem selects worldwide reputable and properly accredited language centers for the delivery of courses. The student who is interested in participating in a language course taught by one of the language Centers of the system through the registration process detailed below.

1.- Conditions of contract

EbooSystem advises people interested in participating in a language course in some of the collaborating centers. EbooSystem selling intermediate language courses offered in the system. EbooSystem offers its clients / students the possibility of making an online reservation in real time through the reservation system in real time, without having to ask for availability and if the payment method chosen is "credit card" Visa or Mastercard, you get a real time confirmation of the reservation. EbooSystem offers its customers the access to an extranet which contains information on pre-booking or reservation, a travel guide with useful information on the selected city, indications about the general operation of the language center and an electronic correspondence system between the client and the selected center. EbooSystem does not charge customers any fee for this service, ensuring the minimum selling price. Data traffic between the client and the system runs under SSL encryption certificate issued by the company "VeriSign"

2.- Booking process and payment

The registration process is subject to RDL 1 / 2007 of 16 November, which approved the text of the General Law for the Protection of Consumers and Users and Law 34/2002 of 11 July, services of information society and electronic commerce. For making the reservation, the student / customer must fill out a booking form with requested personal data, including, if the payment form is card, the data. The student / customer will pay the total amount of the selected course to EbooSystem. Payment can be formalized through two channels: bank transfer or direct debit credit card. The amount of the course will be addressed by each Collaborating Center. To be determined in the information published by the Center on the extranet. If payment method is credit card, the information has to be included in the booking form and the charge will be immediate. EbooSystem has a virtual platform payments that validates through an informatic application the authenticity of the card data. This service enables an immediate charge card and therefore an immediate booking confirmation. In case that students choose the payment method of bank transfer, EbooSystem guarantees a temporary block booking of 3 days ("pre-booking"). This "pre-booking" will become formal reservation for all purposes once the receipt of the bank transfer. Once submitted the booking form the client immediately displays the following information: - In case of chosen as payment method "credit card", students can view an instant confirmation of the booking. Students receive inmediatly at their email account the login information to access to the extranet system. - In case of chosen as payment method "bank transfer", students can display a block booking with 3 days of vailidity (pre-booking). Students receive inmediatly at their email account the login information to access to the extranet system. In case there is no cash repayment of the bank transfer 3 days after, the pre-reservation is canceled.

3.- Conditions for modification and / or cancel bookings

The cancellation and / or changes to reservation are applicable in all cases, regardless of cause. Before the course begins: In case of cancellation of booking by the student before starting the course, the policy is as follows: a) Until 21 days before the start of the course is penalized with 5% of the total invoice amount as compensation. b) Between 21 and 7 days prior to the start of the course is penalized with 10% of the total invoice amount as compensation. Within 7 days before the start of the course is penalized with 15% of the total invoice amount as compensation. In case of modifications in reserve by the student before starting the course, the policy is as follows: a) Until 21 days before the start of the course is penalized with 3% of the total invoice amount as compensation. b) Between 21 and 7 days prior to the start of the course is penalized with 7% of the total invoice amount as compensation. c) Within 7 days before the start of the course is penalized with 12% of the total invoice amount as compensation. The refund will be issued by the same method that the payment has been formalized within 72 hours following the issuance of the cancellation. In the case of existing expenses for making the bank, EbooSystem will deduct these amount from the refund amount. Once the course has started: EbooSystem does not accept cancellations once the course has started. The modifications of the course or other contracted services will be negotiated directly with the language center, not being in any way EbooSystem responsible for these changes. The centers may publish their special policies and they supersedes the EbooSystem conditions only when these are related to the content and aspects fo the course offered. These special conditions will be reflected in the description of the center. See special conditions in case of a visa.

4.- Payment in foreign currency

The credit card payment option can pay in Euros or in its own currency, reporting the exchange rate.

5.- Under 18 years

Reservations in stating that the course participant is under 18 years, must be accompanied by an authorization from parents / guardians. Group bookings with participating under 18 years must be accompanied by an adult.

6.- General rules of the schools

Students accept the general rules of conduct established by the centers. The center reserves the right to expel a participant who display inappropriate behavior or violation of the law, without offset or economic return.

7.- Visas

Participants requiring visas will receive a certificate of EbooSystem signed and stamped with the data from the booking confirmation and invoice. Once issued the certificate signed and sealed for visa shall govern the cancellation policy above only if the visa has been denied. The student shall always establish that refusal to carry the conditions of cancellation or modification. In any other case it will no return of any invoice amount.

8.- Medical insurance

EbooSystem recommends participants to be covered by a health insurance. Should not have medical insurance, most schools offer the possibility of hiring one. Prices vary depending on the center, and taking an average cost about 25 Euros per month. This additional service can be hired after the booking through the mail system. European citizens that have the E111 social security document must bring it.

9.- National holidays

Each center will establish its own festival calendar.

10 .- Class Material

Most of the collaborating centers include the class material in the course fee. The centers that do not include the class material specified the price in the course description page. Class material means the basic and necessary material for the course. This does not include dictionaries.

11.- Reservation fee

There is no fee for reserve. The centers that require a fee for this concept, include it in the course price.

12.- Course Fee and Accommodation

In all cases the course fee includes the registration fee. The centers usually include in the price of course some cultural and leisure activities. These are reflected in the course description. Most centers include the class material and if not, they specifically specify the cost of it. Activities that are not included in the price of the course will be itemized and specified by each collaborating center stipulating price.

13.- Transfer service from /to the airport

Most of the language centers offer this service. It is possible to book the transfer service through the extranet once the reservation has been made. The price of this service is different at each center and mainly depends on the distance between the airport and the language center. The average price for this service each way is 35 Euros.

14.- Travel guide

The participant will have access to the extranet to a detailed travel guide that includes all the information about the first day of arrival to the selected city and other information related to the course, accommodation and the language center. In the case that is not possible to access to the intranet for technical reasons,it will enable a telephone and email contact.

15.- Responsibility

The content related to sections of the language centres, courses or are directly inserted by the collaborating centers through an extranet system taking responsibility for them. EbooSystem is not responsible for the contents or of their possible changes. All possible changes, modifications, and all matters concerning the content, contracted services or any aspect definitely related to the course, must be addressed, negotiated and resolved between student and the collaborating center. In no case shall be responsibility of EbooSystem. In case of dispute must be settled between the student and a collaborating center. The student expressly disclaims liability for EbooSystem.

16.- Protection of personal data

In fulfilling this contract, EbooSystem, as a service provider may collect personal data of users / students / subscribers, further treatment, for which seek the consent of users, pledging the fulfillment of all obligations will become legally payable according to the processing of personal data by the provisions of protection of Personal Data. Personal data will be incorporated into an automated file which is owned and managed by EbooSystem for its commercial and operational purposes. In accordance with the provisions of art.12 of Law 15/1999 of 13 December on the Protection of Personal Data shall not be held data communications over the data servers or access by the Centers part of it or its personnel, taking into account that as owner of the files and responsible for their treatment, accurate for the purposes of this agreement necessarily Center services for the provision of services. The access of personal data by the Centers will be that which is absolutely indispensable for the provision of the obligations under this agreement. The Center is committed exclusively to use the data to which access the exclusive purposes of this contract. The Center as a potential charge of this treatment, only process the data according to the instructions from the file and in any case it shall not use such data for a purpose other than the subject of this contract, nor communicate, even to be held on other people. EbooSystem, as responsible for the files, make their best efforts and agrees to adopt appropriate technical and organizational measures to ensure the security of personal data and avoid its alteration, loss, unauthorized access or treatment, given the state of technology, the nature of the data and the risks to which are exposed, whether from human action or the physical or natural, all in accordance with current legislation on the subject. Is ultimately responsible for processing the data from their clients are forced by their side and to the extent legally appropriate, to keep informed of their rights to third party recipient of their services in relation to their data staff. Similarly satisfy third parties so require application to pursue their rights of access, modification, correction, opposition and cancellation of data in accordance with current legislation on the subject, by email or letter to EbooSystem, Plaza of Mercy No 22, 1st Floor, 29012, Málaga.

17.- Jurisdiction

The parties agree that any and all disputes, disagreement, question or complaint resulting from the implementation or interpretation of this Agreement shall be settled by the Courts of the city of Malaga.
